🔺Taking the Husband’s name after marriage……Not based on Sharee’ah🔺

By Asma bint Shameem

In our eagerness to copy everyone around us, we Muslims have adopted many of their practices which have no basis in the Sharee’ah.
And among them is the practice of a woman changing her family name to that of her husband after she gets married.
The fact is that Islaam does not require a woman to change her name at the time of her marriage and there is nothing in the Sunnah to indicate that a woman should take her husband’s name after she gets married.

Actually, the Ulama tell us that this is an innovated practice that is not approved of in Islaam.

Now, I know some people will say…
“ Oh, come on…What is the big deal?!!”

So read on and you will know what I mean….

The wives of the Prophet ﷺ are the Mothers of the Believers, and the Prophet ﷺ is the noblest of people and the best example.

And yet when we look at their example, we will realize that when the Prophet ﷺ married any of his wives, NOT ONE of them took his name.
On the contrary, each one of them kept her father’s name even if her father was a kaafir.

Similarly, the wives of the Sahaabah and those who came after them did not change their names.
Did you ever think why they didn’t do that?

Surely, if it was a good thing, the wives of the Prophet ﷺ would have done it and the Prophet ﷺ would himself have instructed it and encouraged them to do it.
But he ﷺ didn’t.

That is because it is Allaah’s order to keep your father’s name as an indication of your lineage.

🍃 Allaah says:

“Call them (adopted sons) by (the names of) their fathers, that is more just with Allaah…”
(al-Ahzaab 33:5)

🍃 And the Prophet ﷺ said:

"Whoever calls himself by other than his father’s name, will be cursed by Allaah, the angels and all the people." (Ibn Maajah 2599; Saheeh by al-Albaani in Saheeh al-Jaami 6104)

🍃 And he ﷺ also said:

“Whoever knowingly claims to belong to anyone other than his father, Paradise will be denied him.” (al-Bukhaari 6766, Muslim 63)

🔺 Now some might argue….

“But the woman is not claiming that her father is someone else.
She is just honoring her husband or she doesn’t mean it that way.
She just wants to belong to her husband out of love for him.”

To those people I say….

If it was a matter of “honor” to have the husbands name attached to the wife’s name, wouldn’t the wives of the Prophet ﷺ have done that?

Isn’t it the biggest honor in the WORLD to have the name of the Prophet ﷺ attached to yours?

And yet the wives of the Prophet ﷺ didn’t do that.

Ever wondered why??

And if it was a matter of expressing love for the husband, no relationship between a husband and wife on the face of this earth was better than the relationship between the Prophet ﷺ and his wives.

And yet NONE of the Mothers of the Believers expressed their love for the Prophet ﷺ by changing their last names.

🔺 The last name is actually an indication of the father of the person and represents the person’s lineage.

🍃Shaykh Bakr Abu Zayd said:

“This is one of the beauties of Sharee’ah, because calling a person by his father’s name is more appropriate for knowing who is who and telling people apart…..” (Tasmiyat al-Mawlood, 30, 31).

🔺 Not only is it so in this world,  but, we will also be called by our father‘s name in the Hereafter as well.

🍃 The Prophet ﷺ said:

“On the Day of Resurrection, each betrayer will have a banner raised beside him, and it will be said, this is the betrayer of So and so, the son of So and so.”
(al-Bukhaari 6177, Muslim 1735)

🍃Someone asked Shaykh al-Albaani about a married woman replacing her last name with her husband’s last name:

Shaykh al-Albaani said:

“This is impermissible because:

[1] This is a non-Muslim practice.
[2] The Prophet ﷺ said:

“Whoever knowingly claims to be the son of anyone other than his real father has disbelieved.”
(al-Bukhaari 3508 and Muslim 61)” (Ashritah Mutafrriqah, 5/304)

🍃The scholars of the Permanent Fatwá Committee said:

“A person must ascribe to his father.

Allaah said:

‎ادْعُوهُمْ لِآبَائِهِمْ هُوَ أَقْسَطُ عِندَ اللَّهِ

“Call them after their fathers. This is more just before Allaah.”
(Al-Ahzaab, 33:5)

Numerous texts state that anyone who fails to ascribe to his father is susceptible to a severe punishment. Therefore, ascribing to one’s husband [after marriage]—as the non-Muslims commonly do and those Muslims who emulate them—is impermissible.”
(Fataawaa al-Lajnah al-Daa’imah, vol. 20, pg 378)

🔺Think about it…

Originally, the woman is ‘the daughter of so and so’, and NOT ‘the wife of so and so’.

Since there is no blood relationship between the husband and wife, how can she take his last name as if she is part of the same lineage?

Also what happens if she gets divorced, or her husband dies, and she  marries another man?
Will she keep changing her last name every time she marries another man?

In addition to this, there are rulings attached to the woman being named after her father, which have to do with her inheritance, spending and who is her mahram, etc.
Taking her husband’s last name overlooks all that.

Also, if you think about it, the husband is named after his own father, and what does she have to do with the lineage of her husband’s father?
This goes against common sense and true facts.

Besides, the husband has nothing that makes him better than his wife’s father.

So why should she give up her father’s name and  take her husband’s last name?

And why does the man get to keep his father’s name and not the woman?

It just doesn’t make any sense.

So, all you single females out there, don’t be in such a hurry to change your maiden name after you get married.

And those of you who have already done that, it is never too late.
Take back your maiden name and reclaim your identity.
It is part of the Sharee’ah.

And Allaah knows best

"If Allah should aid you, no one can overcome you; but if He should forsake you, who is there that can aid you after Him? And upon Allah let the believers rely." (QURAN 3:16

This verse from the Quran, specifically emphasizes the unwavering faith and trust that believers should place in Allah. It reminds us that 𝐢𝐟 𝐀𝐥𝐥𝐚𝐡 𝐬𝐮𝐩𝐩𝐨𝐫𝐭𝐬 𝐮𝐬, 𝐧𝐨 𝐟𝐨𝐫𝐜𝐞 𝐢𝐧 𝐭𝐡𝐢𝐬 𝐰𝐨𝐫𝐥𝐝 𝐜𝐚𝐧 𝐨𝐯𝐞𝐫𝐩𝐨𝐰𝐞𝐫 𝐮𝐬.

However, if we are neglected by Him, no one else has the power to provide assistance. It reinforces the idea that believers should place their complete reliance on Allah, seeking His guidance and help in all matters of life.

🤲🏻 O Allah, grant us unwavering reliance upon You in all aspects of our lives. Aamiin.

🌸 *FRIDAY SERIES*🌸

❓ *QUESTION*❓

*Should I pray Dhuhr AFTER I have prayed Jumu’ah*❓

🌿 *ANSWER*🌿

The Friday prayer is prayed *INSTEAD* of Dhuhr on Fridays.

So there’s NO NEED to pray Dhuhr after praying Jumu’ah in congregation.

In fact it’s AGAINST the practice and teachings of the Prophet Sal Allaahu Alaiyhi wa Sallam.
And there’s NO EVIDENCE of him doing that. EVER.

Whenever the Prophet sal Allaahu Alayhi wa sallam finished praying the Jumu’ah prayer, he Sal Allaahu Alaiyhi wa Sallam did NOT pray Dhuhr or ANY OTHER obligatory Salaah.
All he read was the Sunnah after the prayer.
That’s it.

Similarly, the Sahaabah also did NOT pray Dhuhr after praying Jumu’ah.

And why should they?

They never saw the Prophet ﷺ praying Dhuhr on the day of Jumu’ah
Nor did the Prophet ﷺ ever teach them that either.

So praying Dhuhr after praying two rak’aat of Jumu’ah is NOT part of the Sharee’ah.

🍃 Shaikh Ibn Baaz said:

“Allaah has NOT prescribed any prayer at noon time on Fridays except ONE obligatory prayer for men who are residents and are settled (i.e., not traveling), free and accountable, which is the *Jumu’ah prayer*.
If the Muslims do that, then there is no other obligation upon them, be it Dhuhr or any other prayer.
*Jumu’ah prayer* is the obligation of that time.”
(Majmoo’ Fataawa Wa Maqaalaat Mutanawwi’ah Li Samaahat, Part 12, P. 363)

🔺Actually it’s BID’AH to pray Dhuhr after Jumu’ah prayer and bid’ah is a HUGE SIN!

🍃 Shaikh Ibn Baaz said:

“Undoubtedly praying Dhuhr after Jumu’ah is something INNOVATED which is NOT a part of the Deen of the Prophet Sal Allaahu Alaiyhi wa Sallam.
So it is to be REJECTED and is to be included in the innovations and misguidance against which the Prophet Sal Allaahu Alaiyhi wa Sallam warned us.”

🍃 And he said:

“Praying Dhuhr after Jumu’ah is a bid’ah and a going astray, instituting a new way which Allaah has not prescribed.
We must NOT do this; we must beware of it and warn people against it, and *limit ourselves to doing Jumu’ah prayer only*, as was the way of the Messenger of Allaah Sal Allaahu Alaiyhi wa Sallam, his companions after him and those who have followed them in truth until the present day.
This is the truth concerning which there is no doubt.”
(Majmoo’ Fataawa -Part 12, P. 363)

❓ *QUESTION*❓

*What if I’m praying at HOME on a Friday afternoon?*

Jumu’ah prayer is ONLY VALID when praying in congregation in the MASJID.
Reading two rak’aat of Jumu’ah prayer is NOT VALID at home.

So if you’re a woman, or a traveler or sick etc and you’re not praying in the masjid on Friday afternoon for some reason, then you have to pray *Dhuhr* at home, just as you would any other day.

And Allaah knows best
